Copyright, Fair Use, Parody and Fan Art – What Animators Should Know

HOT COCOA SHOW! This week we talk all about Copyright, Fair Use, Parody, Fan Art and more in a discussion that’s centered around a blog post I made on the topic a couple days ago (click here to check that would which ALSO has this episode embedded in it for good measure)! Creators on the internet mostly get the blame for using and sometimes abusing copyrighted material in their own creations. Sometimes they constitute something new and other times they’re not at all covered under fair use and are basically just stealing, whether intentional or not. As pointed out early in the show, ignorance is not a defense against copyright infringement. However! “Internet creators” are not unique in this area, there’s just a lot more artists sharing their work now than there used to be… and much of that work is the exploratory stuff nobody ever used to be privy to in the pre-internet age.

Because the copyright has been extended to such a degree that more of the art which is actually still relevant in our time is copyrighted (proportionate to in the past when the copyright term was much shorter), the risk of stepping into legal quicksand is actually even more probable now. More creators, being seen earlier in their careers than ever before, in a time of extended copyright on the pop culture that itself is uniquely used as a cultural reference point of expression… that’s complicated!! I aim to make things clearer for you by making it clearer for my co-host Rob in this episode of the podcast and help further in the companion blog post which I encourage you to check out.

Adi Shankar Castlevania miniseries, Nintendo coming back to movies and Rovio cuts workforce by a third

We’re talking all Video Game related stories this week but start with a question: is “Animations” a word? Nintendo said they want more control over their movie properties, fan-film producer Adi Shankar (Judge Dredd: Superfiend, Power/Rangers) and Fred Seibert (Frederator) want to make a dark Castlevania animated mini-series, and Rovio cuts a third of their work force. This week we also play a game where Stephen reads out all the video game movies that have been made thus far and Rob and Pat try to guess what their Rotten Tomatoes rating is… I know this is cliche, but the answers may surprise you! The audience question this week is a great one about what animated series we would cancel in order to revive another.

Sesame Street on HBO, Hollywood Studios’ Antitrust Lawsuit in play & Disney’s THE LION GUARD

It was an interesting week to be a kid. While we’ll start seeing Sesame Stret on HBO, “The Lion Guard” is coming to the small screen in a beautifully animated new series and Stephen saw a family-friendly animated short collection in a local theater, featuring the works of nine animators from around the world. If you happen to be an “adult-kid,” the red-band trailer for “Hell & Back” was posted and the Hollywood Antitrust lawsuit is back in play… OK, this week’s theme is stretched a little bit but it did lead to some VERY interesting discussions! There was technical talk over “The Lion Guard” animation style, social discussion over “Sesame Street” on a premium cable channel, and a bit of budget talk regarding the recommended reading this week (see below).

Disney’s D23 Expo animated film presentations: Moana + Toy Story 4 + Finding Dory + Zootopia + more!

This weekend was Disney’s D23 Expo presentation so we discuss all the information that came out of that… live-action remakes, sequels, and the incredible line-up on Disney and Pixar animation film slate all the way to 2018! Stephen starts the show by giving a mini-review on the British re-dub of the Argentinian animated film “Metagol” (which in the UK is called “Unbeatables”), Rob tells a story about having poop on his shoe and Pat breaks some news. Then we’re off talking about how Furries love Zootopia, why Cars 2 might get too much hate, if Donald Trump was producing the upcoming Dia de los Muertos inspired Pixar movie “Coco” and the problem with trying to make the “definitive” version of a fairy tale. Robb Pratt Interview – Animator behind Superman and Flash Gordon Classic talks cartoons, career and superheroes!

We talked about how and why he started the Classic series, his thoughts on Superman as a character, Flash Gordon and how he relates to Star Wars, various trials and tribulations navigating the business world of animation entertainment, his recent work on “Wabbit” (the Bugs Bunny animated shorts show) and his absolute love of story and art! Animated short “KLAUS” looks like CGI but is hand-drawn animation

An animated bomb called “Klaus” was dropped on the community this week screaming that hand-drawn animation can visually compete with CG in today’s climate. And then the creator, Sergio Pablos, says that he’ll talk about the techniques used to create the short trailer at an Annecy talk. That’s about as close to a mic-drop as we get in the animation field… so we talk about it… a lot!
